I was recently asked by one of my views on YouTube why is Cash Gifting Illegal…Unfortunately I couldn’t go into depth on this matter since YouTube only allows you to comment with less than 500 words. So here is my response to hd79freedom:
The thing that makes cash gifting illegal is the fact that it is no longer a gift when you solicit for it. In other words, if you get your gifts from a marketing campaign where you promise to teach others how to get folks to send them gifts, it’s not really a gift anymore. You may send a note along with your gift saying that you were not solicited and that you are not expecting any remuneration for it, but that doesn’t make it true. In fact, in return for your gift, you DO expect to be supported and to get marketing tools and tips to help you get cash from other people. That is how an Attorney General is going to see it, especially close to an election when they want to show they’re tough on scammers and schemers.
I personally think that people should be able to do what they want to on a voluntary basis, as long as they are not purposely defrauding anyone. However, the US government has different ideas about what people can and can’t do and people have already gone to jail for cash gifting schemes. It’s too easy to do other things that won’t get me into trouble with the law to want to go down the cash gifting road.
Sure it’s possible that I won’t be the guy who gets thrown in jail or loses everything, but do I really want to take that chance? No, not really…
